Public Views on Artificial Intelligence and Intellectual Property Policy

The U.S. government agency that overviews the issuance of patents and trademarks recently undertook an effort to listen to AI technology stakeholders on the importance of their work and its intersection with IP. Indeed, the United States Patent and Trademark Office (USPTO) fully recognizes this emerging technology and as such worked with “community and experts in AI to promote the understanding and reliability of intellectual property (IP) rights in relation to AI technology”.

Back in January 2019, the USPTO held an AI IP (patents, copyrights, trademarks and trade secrets) policy conference on “AI’s impact on inventorship and ownership, eligibility, disclosure, and the level of ordinary skill in the art.” The agency has now released a comprehensive report that synthesizes these public comments into several emerging themes, which serve to guide its understanding of artificial general intelligence (AGI) and shape the USPTO’s Artificial Intelligence and Intellectual Property Policy.
